Equal Opportunity Policy

It is the policy of SWCAP, Inc. to comply with the equal opportunity policy and standards of the Wisconsin Department of Children and Families, the Department of Health Services and the Department of Workforce Development and all applicable Federal and State statutes and regulations relating to nondiscrimination in service delivery.

No otherwise qualified applicant for service or program participant shall be excluded from participation, be denied benefits, or otherwise be subject to discrimination in any manner on the basis of race, color, national origin, age, sex, religion, political beliefs, gender identity, participation in a public assistance program, genetics, or disability. No employee or other person shall intimidate, threaten, coerce, or discriminate against any otherwise qualified individual for the purpose of interfering with any right or privilege secured under one of the applicable civil rights laws, or because they have made a complaint, testified, assisted, or participated in any manner in an investigation, proceeding or hearing under one of the applicable civil rights laws. Program access for persons with disabilities is covered in the Americans with Disabilities Act of 1990 and Section 504 of the Rehabilitation Act of 1973 as amended.

Under the Food Stamp Act and the USDA-FNS policy, discrimination is prohibited also on the basis of religion and political beliefs or affiliation. This policy covers eligibility for access to service delivery and to treatment in all of the programs, services and activities. All employees are expected to support the goals and programmatic activities relating to nondiscrimination in service delivery.

SWCAP Title VI (Discrimination) Complaint Policy

Any person who believes they’ve been discriminated against on the basis of race, color, national origin, disability, sex, age, religion, income status, or limited English proficient (LEP) by SWCAP may file a complaint by completing and submitting SWCAP’s Complaint Form.

The Complaint Form may also be used to submit general complaints to SWCAP.

SWCAP investigates complaints received no more than 180 calendar days after the alleged incident. SWCAP will process complaints that are complete.

Once the complaint is received, SWCAP will review the complaint and work to resolve the complaint informally, if possible.

If the complaint warrants a formal civil rights complaint process, SWCAP will follow the steps listed in this complaint procedure. SWCAP may also use this formal procedure to address general complaints. If SWCAP determines it has jurisdiction the complainant will receive an acknowledgement letter stating the complaint will be investigated by SWCAP as a civil rights complaint.

SWCAP has 60 business days to investigate the civil rights complaint. If more information is needed to resolve the case, SWCAP may contact the complainant.

The complainant has 10 business days from the date of the letter to send requested information to the investigator assigned to the case.

If the investigator is not contacted by the complainant or does not receive the additional information within 10 business days, SWCAP can administratively close the case. A case can be administratively closed also if the complainant no longer wishes to pursue their case.

After the investigator reviews the complaint, one of two (2) letters will be issued to the complainant: a closure letter or a letter of finding (LOF).

  • A closure letter summarizes the allegations and states that there was not a Title VI or ADA violation and that the case will be closed.
  • A letter of finding (LOF) summarizes the allegations and the interviews regarding the alleged incident, and explains whether any disciplinary action, additional training of the staff member, or other action will occur.

If the complainant wishes to appeal the decision, the complainant has 10 business days after the date of the letter or the LOF to do so.
